DAGA Statement on Two Critical Rulings on Medication Abortion

Washington, DC — The Democratic Attorneys General Association (DAGA) issued the following statement after two critical rulings came out regarding the fight for medication abortion access. In Texas, District Court Judge Matthew Kacsmaryk issued a ruling that would ban the abortion pill mifepristone nationwide. The ruling will not take effect for seven days, giving the federal government time to appeal. In addition to the ruling out of Texas, 18 Democratic Attorneys General, led by Washington AG Bob Ferguson and Oregon AG Ellen Rosenblum, won a preliminary injunction in their case that will help millions of Americans continue to have access to mifepristone.

Statement from Delaware Attorney General Kathy Jennings and Nevada AG Aaron Ford, DAGA Co-Chairs:

“Today’s decision out of Texas to ban mifepristone, a safe and effective abortion medication, is a disturbing and extraordinarily dangerous attack against women across the country. We strongly condemn this decision and the ongoing right-wing assault on reproductive rights, medical freedom, and abortion access. Millions of patients have used mifepristone safely over the last two decades, but as we’ve seen across the country, ultra-conservative groups — including some Republican Attorneys General — are not letting science, facts, or basic human rights stand in the way of a medieval crusade against abortion access.

“We also commend our colleagues AGs Ferguson and Rosenblum for a win in our case today that will safeguard access to mifepristone for millions of Americans. Democratic Attorneys General are proud to work in partnership with one another, as well as reproductive rights champions like Planned Parenthood, the Biden-Harris Administration and other state officials to support Americans making their own health care decisions.

“While there are still unknown elements and effects of these rulings, rest assured: Democratic Attorneys General will be on the frontlines of the fight to protect abortion access in every corner of our country.”
