ICYMI: Democratic AGs Win Tariff Lawsuit Against the Trump Administration

Oregon AG Dan Rayfield and Arizona AG Kris Mayes share the details of their lawsuit win and the importance of holding Trump accountable in court
WASHINGTON, DC – Yesterday, the U.S. Court of International Trade ruled in favor of Democratic AGs and blocked the Trump administration’s attempt to implement disastrous and unlawful tariffs that could have cost Americans households $5,200 on average every year.
Co-leaders on the lawsuit, Oregon Attorney General Dan Rayfield and Arizona Attorney General Kris Mayes, took to TV to talk through the lawsuit and what this win means for American families, small businesses, and manufacturers.
Arizona AG Kris Mayes on The Briefing with Jen Psaki:
- “It’s a huge day for American consumers, for small businesses all throughout this country who were on the precipice of being absolutely devastated and harmed by these tariffs. And so we are celebrating this.”
- “The Democratic AGs have sued Donald Trump now, I think, more than 20 times... He has violated federal court orders. And what we have done is we have gone back into the federal court when that happens and we have asked for what’s called a motion to compel.”
- “But what the court is saying is the President does not have unbounded authority to levy these tariffs. And that’s what this was.”
- “We are seeing this administration going after judges, undermining the authority of the judicial branch of government, not respecting the two other branches of government… and now he’s disrespecting judges. And he basically makes these sort of very disrespectful and alarming statements every time he loses a case, and that’s just not how things are done in our country.”
- “These tariffs are causing chaos for our consumers. This is a tax, this is a direct tax on the people of America. And I think that’s why this is such a huge victory and a huge night for our country, because hopefully it’s the start of us getting things back on track and preventing this harm.”

- “It’s a very exciting day. This is a very important ruling for all Americans,” AG Rayfield said. “The genesis of this lawsuit for us was really simple. It’s about people, it’s about small businesses, it’s about the impacts that we’re having in our states.”
- “We are so pleased, not just on behalf of our states, but just all states and all consumers and especially small businesses that were on the verge of being hammered by these tariffs, which really are taxes and tax increases,” AG Mayes said.
- “The court really issued a very strong opinion. They essentially made a decision on the merits of the case and what is essentially a final decision by them,” AG Mayes said.
- “We wouldn’t have brought this case if we didn’t think it was a righteous case,” AG Rayfield said. “And we wouldn’t have brought this case if it wasn’t impacting Americans across this country. And so we feel very confident as we move through the appeals process.”
- “All 23 Democratic attorneys general are working together on these cases,” AG Mayes said. “We have now brought I think a little bit north of 20 lawsuits all together essentially as a coalition…”
- “But these are lawsuits where the president has clearly overstepped his authority,” AG Mayes said. “These, almost all of them, are about the separation of powers and making sure that we protect Americans from the increased costs associated with the actions that the president is taking.”
